3.3 Professional Responsibilities

Elzar endeavours to perform its services with reasonable professional skill, care, diligence and integrity.

Professional advice, reports, research findings, assessments and recommendations are provided based on the agreed scope of work and information made available during the engagement.

Unless expressly agreed in writing, our services do not constitute a guarantee of financial performance, regulatory approval, commercial success or acceptance by any external authority.

3.4 Client Responsibilities

Clients are responsible for providing accurate, complete and timely information reasonably required for the performance of the agreed services.

Any material changes to the agreed scope of work, project requirements or relevant information may result in revisions to the service fees, deliverables or completion timeline, subject to mutual agreement.

3.5 Intellectual Property

Ownership and permitted use of reports, research outputs, advisory opinions, training materials, software, technology solutions and other deliverables will be governed by the applicable service agreement.

Unless otherwise agreed in writing, Elzar retains ownership of its pre-existing proprietary methodologies, frameworks, templates, software components and professional know-how.

Clients may use deliverables only within the rights granted under the applicable engagement agreement.

4. Service Pricing and Fee Transparency

4.1 Quotation-Based Pricing

As Elzar provides specialised and customised professional services, our fees are generally determined on a project-specific or quotation-based basis.

Accordingly, not all services are offered at fixed or publicly displayed prices.

Professional fees may depend on:

  • The nature and complexity of the assignment.

  • The agreed scope of work and deliverables.

  • The level of professional expertise required.

  • Project duration and resource requirements.

  • Technical or regulatory complexity.

  • Additional services or third-party expenses.

Clients may request a quotation by contacting the Company through its official communication channels.

4.2 Disclosure of Fees Before Payment

Before requesting or accepting payment, Elzar will communicate the relevant fees and payment conditions through an authorised quotation, proposal, invoice, order confirmation or service agreement.

The information provided will include, where applicable:

  1. Description of the service or project.

  2. Agreed professional fee or total transaction amount.

  3. Applicable taxes and additional charges.

  4. Payment milestones and due dates.

  5. Accepted payment methods.

  6. Estimated commencement or delivery timeframe.

Clients will be informed of the total amount payable and applicable payment conditions before being requested to complete a transaction.

Where services or products are offered for direct online purchase, the applicable price and mandatory charges will be presented before final payment confirmation.

4.3 Currency and Taxes

Unless otherwise agreed in writing, fees and invoices are denominated in Malaysian Ringgit (MYR).

Any applicable taxes, statutory charges or additional costs will be communicated to clients before payment.

For international transactions, foreign currency conversion and related charges may be imposed by the relevant financial institution, card issuer or payment network.

4.4 Changes in Service Fees

Any variation to an agreed fee resulting from additional services or changes in scope will be communicated to the client for acceptance before the additional charge is incurred.

4.5 Pricing and Payment for Digital Platforms and Technology-Based Services

In addition to customised consultancy and professional advisory services, ELZAR SHARIAH AND TECHNOLOGY SOLUTION SDN. BHD. offers digital platforms, artificial intelligence applications, online tools, subscription-based services and other technology-related products.

Unlike consultancy engagements, which are generally priced through individual quotations, fees for standard digital products and services are displayed transparently on their respective official pricing pages or at the point of checkout.

These platforms include, but are not limited to:

Depending on the product or service, payment arrangements may include subscriptions, prepaid credits, usage-based packages, one-time purchases or other pricing models specified on the relevant platform.

Before completing a purchase, customers will be informed of the applicable price, selected package or subscription, payment frequency (where applicable), and any additional taxes or mandatory charges.

All online payments for these digital products and services will be processed through the Company’s appointed payment gateways, including CHIP, Stripe or other payment service providers duly licensed, registered, approved or otherwise authorised to provide the relevant payment services in Malaysia, subject to their respective approval and activation.

Where recurring payments or automatic renewals apply, the billing frequency, renewal conditions, cancellation procedures and relevant subscription terms will be disclosed before the customer authorises the transaction.

A payment will only be submitted after the customer has been presented with the applicable charges and has confirmed the purchase through the relevant checkout process.

Prices and packages may be revised from time to time. The price applicable to a particular purchase will be the amount displayed and confirmed at checkout, subject to any mandatory legal requirements or applicable contractual terms.

Digital product purchases, subscriptions and prepaid credit packages are subject to the relevant platform’s terms of use, cancellation and refund conditions, together with applicable Malaysian consumer protection laws.

5. Payment Methods and Transaction Procedures

5.1 Accepted Payment Methods

Subject to availability, provider approval and activation, Elzar may accept payments through:

  • Online bank transfers.

  • FPX or supported online banking facilities.

  • Credit and debit cards.

  • CHIP, Stripe or other authorised payment service providers.

  • Other payment methods expressly approved and communicated by the Company.

Only payment methods actually available through our authorised payment channels will be offered to clients.

Step 2: Quotation or Proposal

Elzar provides a written quotation, proposal or service agreement specifying the scope of work, fees, payment terms and relevant conditions.

Step 3: Acceptance

The client reviews and accepts the applicable commercial terms.

Step 6: Transaction Confirmation

Upon confirmation of a successful payment, Elzar provides or makes available an acknowledgement, receipt or applicable transaction record.

Step 7: Service Delivery

The relevant services commence or continue in accordance with the agreed engagement terms and payment milestones.

5.3 Payment Security and Verification

Payments processed through our appointed payment service providers are subject to their applicable security requirements, transaction verification procedures and fraud prevention controls.

Card transactions may require additional authentication by the relevant card issuer or payment network.

Elzar may reasonably delay service commencement or request additional payment verification where a transaction is flagged as suspicious, incomplete or unauthorised.

5.4 Failed, Duplicate or Unauthorised Transactions

Clients experiencing failed payments, duplicate charges or suspected unauthorised transactions should contact Elzar promptly.

We will review the reported transaction and, where appropriate, coordinate with the relevant payment service provider or financial institution to facilitate investigation, correction or refund.

Clients should verify the status of an unsuccessful transaction before attempting another payment to avoid duplicate charges.

5.5 Payment Records

Elzar maintains appropriate records of invoices, payment confirmations and transaction references for accounting, business administration, audit and applicable legal compliance purposes.

5.6 Direct Online Payments for Digital Products

For digital platforms and technology-based products, including ShariahLab AI and MyHajiUmrah, customers may purchase subscriptions, prepaid credits or other available packages directly through the relevant platform.

Customers will be able to review the applicable pricing, package details and payment terms before proceeding to the payment gateway.

Upon successful payment confirmation, access to the purchased digital services, subscription entitlements or credits will be provided in accordance with the applicable platform terms.

Transaction confirmations, payment records or receipts will be made available through the relevant platform, by email or through other authorised communication channels, as applicable.

The standard quotation-based payment procedure described in Section 5.2 applies primarily to customised consultancy and professional engagements and does not necessarily apply to direct online purchases of standard digital products.

6. Cancellation, Refund and Return Policy

6.1 General Policy

Elzar primarily provides professional consultancy, advisory, research, training and technology-related services.

Accordingly, the conventional return of physical goods is generally not applicable to our services.

Refund and cancellation arrangements depend on the nature of the engagement, agreed contractual conditions, work already performed, expenses reasonably incurred and the client’s applicable statutory rights.

Nothing in this policy excludes or restricts rights or remedies that cannot lawfully be excluded under Malaysian law.

6.2 Cancellation Before Service Commencement

Where a client requests cancellation before substantive work has commenced, any advance payment may be refundable, subject to reasonable and previously disclosed costs or commitments incurred specifically for the engagement.

Any proposed deduction will be assessed in accordance with the applicable agreement and legal requirements.

6.3 Cancellation After Service Commencement

Where an engagement is cancelled after work has commenced, Elzar may retain or charge fees reasonably attributable to completed services, work performed and properly incurred expenses, subject to the relevant agreement and applicable law.

Any eligible refund will be assessed based on the actual status of the engagement and the applicable contractual terms.

6.4 Training, Workshops and Professional Programmes

Cancellation, postponement, participant substitution and refund conditions for training programmes, workshops or scheduled professional events will be communicated in the relevant registration terms or programme confirmation.

Where Elzar cancels a paid programme without providing the agreed service, an appropriate remedy will be offered, which may include a refund or an alternative arrangement accepted by the participant.

6.5 Technology and Digital Services

Refunds relating to software development, artificial intelligence solutions, digital platforms, subscriptions or technology-related services will be assessed according to the applicable service agreement or subscription terms.

Any minimum subscription period, recurring charge, cancellation restriction or non-refundable fee will be communicated before purchase where applicable.

6.6 Incorrect Charges or Failure to Deliver

Where a verified duplicate charge, incorrect payment amount or failure to provide the agreed service has occurred, the client may request an appropriate correction, refund or other remedy.

The Company will assess such requests fairly and in accordance with the relevant agreement and applicable Malaysian law.

  • Client name or organisation.

  • Invoice or transaction reference.

  • Date and amount of payment.

  • Description of the service purchased.

We will acknowledge and review refund requests within a reasonable period.

Approved refunds will ordinarily be processed through the original payment method where technically possible and permitted by the payment service provider.

The time required for refunded funds to appear in the client’s account may vary depending on the payment provider, acquiring institution or card issuer.

7. International Clients and Foreign Card Payments

7.1 International Service Engagements

The availability of international card payments is strictly subject to the appointed payment service provider’s approval, confirmation and activation of the relevant international card processing facilities for Elzar’s merchant account.

International card payments will only be offered after the relevant payment service provider has confirmed that the facility is approved, activated and operational for the Company.

Acceptance of a particular foreign-issued card is not guaranteed and remains subject to the requirements of the payment provider, acquiring institution, card issuer and applicable payment network.

7.3 Currency and Foreign Exchange Conversion

Unless otherwise specified in the applicable quotation, invoice or agreement, payments are charged in Malaysian Ringgit (MYR).

For foreign-issued cards, the card issuer or relevant payment network may convert the transaction amount into the cardholder’s billing currency.

Exchange rates, international transaction fees and foreign currency conversion charges may be determined and imposed by the relevant financial institution or payment network.

Such charges are outside Elzar’s control unless expressly stated otherwise.

7.4 Cross-Border Regulatory Compliance

International payment transactions are subject to applicable Malaysian laws, relevant payment provider requirements, anti-money laundering and counter-terrorism financing requirements, applicable sanctions restrictions and payment network rules.

Elzar may request additional transaction verification or supporting information where reasonably necessary for compliance purposes.

We reserve the right to decline or restrict transactions involving suspected fraud, prohibited activities, restricted parties or other circumstances where processing would contravene applicable laws or payment provider requirements.

7.5 Alternative Payment Arrangements

Where international card payments are unavailable or unsupported, clients may be offered alternative authorised payment arrangements, including bank transfers or other permitted payment methods.

Any such arrangement will be subject to the Company’s acceptance, the applicable financial institution’s requirements and relevant Malaysian laws.

8. Limitation of Liability and Dispute Resolution

8.1 Professional Services

Elzar provides professional services with reasonable care, diligence and skill, based on the agreed scope of engagement.

Unless expressly provided in the relevant agreement or required by law, the Company does not guarantee a particular commercial outcome, regulatory decision or financial result.

To the extent permitted by applicable law, contractual liabilities and remedies will be governed by the relevant service agreement.

Nothing in these terms excludes liability or statutory protections that cannot lawfully be excluded or restricted.

We will endeavour to address complaints fairly, professionally and within a reasonable timeframe.

Any unresolved dispute will be subject to the applicable contractual dispute-resolution provisions and governing law.

8.4 Governing Law

These terms are governed by and interpreted in accordance with the laws of Malaysia, subject to applicable mandatory legal protections and any enforceable dispute-resolution arrangements.

9. Amendments to This Policy

Elzar may update or amend this policy to reflect changes in business operations, professional services, legal requirements, technology arrangements or payment processing procedures.

The latest version will be published on our official website with the relevant effective or revision date.
